Abstract

This article analyzes the legal controversy arising from Supreme Decree 001-2022-TR, which restricted the outsourcing of activities related to a company’s core business. It examines the challenges raised before the Constitutional Court, INDECOPI, and the Judiciary, as well as the effects of its annulment by the Supreme Court through Popular Action Case 30989-2023-Lima, and the legal framework currently governing labor outsourcing in Peru.
