The ground set out in Article 63.1(e) of the Arbitration Law requires the judge to verify whether the award ruled on a matter that is manifestly non-arbitrable. This article examines whether that review conflicts with the prohibition on reviewing the merits under Article 62.2 of the Arbitration Law, and argues, drawing on the kompetenz-kompetenz principle set out in Article 41 of the same statute, that the answer is no.
