Abstract

Artificial intelligence can find precedents, organize arguments, and even draft an arbitral award. But can it decide? In arbitration, parties do not merely choose an outcome: they choose the person who will construct it. The real boundary lies not in using technology, but in allowing it to replace the arbitrator’s judgment. Because if an algorithm reasons and the arbitrator signs, who really decided?
