Abstract

The author reflects towards the rule of receptivity in matter of contractual declarations, emphasizing the exercise of the expressly cancellation clause. For this purpose, he bases his argument on the Cassation 1725-2016-Lima-Este as binding jurisprudence, in order to develop a critical view of the Peruvian judicial system.
