Abstract

The “APP Law” regulates the intervention of regulatory bodies as adjuvants to the State entity in arbitrations that involves decisions or matters related to their jurisdiction under the contract. However, as addressed in this article, this special form of intervention has incompatibilities with the procedural institution on which it is inspired and several practical challenges that demands to rethink its regulation.
