Abstract

In the following paper, relying on authoritative doctrine an empirical data, the authors support the idea that the arbitration is an evolutionary phenomenon that captures the best practices of the civil law system and common law. Finally, they comment on the role of soft law in international arbitration and the importance that lex mercatoria plays today.
